DICHIARA
quanto
segue:

i
contenuti dei database possono essere soggetti alla normativa vigente
sulla privacy, qualsiasi
informazione circa il database, le password di accesso e il suo contenuto sono da
ritenersi riservate non verranno cedute o vendute a terzi e saranno conservate
in luogo sicuro e non accessibile se non per le persone autorizzate; in caso di
fughe di
informazioni, o anche in caso di sospetto del verificarsi di tali eventi, Coster T.E. S.p.A. dovra' essere avvertita
prontamente,

le
informazioni cedute da Coster
T.E. S.p.A riguardano solo la struttura dei database non il loro
contenuto,
-
di
essere a
conoscenza che:
-
Coster
T.E. S.p.A. non
si assume nessun tipo di responsabilità per eventuali malfunzionamenti
del programma SWC 701 o eventuali danni causati dallo stesso dovuti a una
qualsiasi manipolazione dei database. In tale caso il produttore annulla
la garanzia sul software SWC 701 e su qualsiasi impianto telegestito
fatta eccezione delle sole apparecchiature non telegestite.

Coster
T.E. S.p.A. non
garantisce la compatibilità, tra SWC 701 e la parte di software
sviluppata dal richiedente. La struttura e la password dei database,
essendo l’SWC 701 in continua evoluzione, potranno essere modificate a
piacimento da Coster
T.E. S.p.A. senza
nessun obbligo di avviso o preavviso

Qualora
fosse richiesto l'aggiornamento del programma SWC 701, il richiedente
dovrà accertare che la nuova versione del SWC 701 e' compatibile con le
altre applicazioni. Nel caso in cui una qualsiasi applicazione non fosse piu'
compatibile con i database del SWC 701 tutte le modifiche ai software del
richiedente sono a suo esclusivo carico,

T.E. S.p.A., e' disposta a dare un supporto tecnico, unicamente
riguardo i temi di questa liberatoria e presso la sede del produttore o
via email, previo appuntamento da concordare con l’ufficio Ricerca e
Sviluppo sezione software.

tutte le responsabilita' circa l'uso dei database (password,
struttura e contenuti) sono del
richiedente,
-
le
informazioni sulla struttura dei database sono state cedute gratuitamente da Coster
T.E. S.p.A al richiedente,
-
il
richiedente terra'
sempre informato il produttore circa l'uso che viene fatto dei database. Tali informazioni verranno custodite da Coster T.E.
S.p.A. e non cedute a terzi a meno che vengano richieste in forma
scritta dalle Autorita' competenti.

This agreement is to be printed on headed paper of the company making
the request, signed by its legal representative and sent via fax for an
immediate reply with the original sent by normal post.

hereinafter called the
applicant, requests Coster T.E. S.p.A., hereinafter called the
manufacturer, for permission to use
the SWC 701 software databases by access to these using any software different
from SWC 701. In this respect the
applicant.
DECLARES as follows:
-
the
contents of the databases may be subject to the current legislation on
privacy: any information regarding the
database, the access password and its
contents are to be considered confidential and must not be disclosed
or sold to
third parties and shall be stored in a safe
place accessible only to authorised persons;
in the event that information is leaked, or suspected to have been
leaked,
Coster T.E.
S.p.A. must be informed immediately.
Coster T.E. S.p.A.
does not accept any responsibility whatsoever for
any
malfunctioning
of the SWC 701 program or for any damage caused by this
due to any manipulation of the databases. In the event of the latter, the
manufacturer shall annul the guarantee on the SWC701 software and on any
telemanaged plant site with the sole exception of those electronic devices
not
telemanaged.
Coster T.E. S.p.A. does not guarantee the compatibility between SWC 701
and any
software developed by the applicant. Since SWC 701 is being
continuously developed, the structure and the password can be modified as
Coster T.E. S.p.A. thinks fit, without any obligation on the part of Coster
T.E.
S.p.A. to give
notice of such changes before or after they have taken place.
Should
the updating of the SWC 701 program be requested, the applicant
must ensure that the amended version of SWC 701 is compatible with
the
other applications. Should any one application not be compatible with the
SWC 701 databases, all the amendments to the applicant’s software shall be
at
the applicant’s expense.
Coster T.E. S.p.A.
agrees to provide technical
assistance solely in regard to the contents of this agreement at its Head
Office or via email after agreement has been reached with the Software
Section of the Research & Development Department.
